Recently, the investor Thai Beverage Public (ThaiBev) lodges a complaint to Vietnamese government that ThaiBev has not been directly engaged in the Board of Directors and the operation of Sabeco since completion of the transaction acquiring 53.59% of Sabeco's shares via Vietnam Beverage Company Limited in late 2017. This volume will introduce some perspectives of this issue.
The introduction of Decree 05/2015/ND-CP guiding the Labor Code 2012 has partially untied several difficulties and troubles in application of this Code and also obtained positive comments from agencies, businesses, and employees. However, after 3 years of implementation, this Decree has revealt some shortcomings that need amending and supplementing to lessen enterprises' problems in using employees, and to enhance the capacity of agreement by employees and employers in their conclusion of labor contracts. Therefore, in February 2018, the Ministry of Labor, War Invalids and Social Affairs submitted the Government the Draft Decree on amendment and supplementation of some articles of Decree 05/2015/ND-CP providing details and guidelines for implementation of some contents of the Labor Code. In this volume, NHQuang&Associates will share some viewpoints of this Draft Decree.
Purporting at creating an institutional breakthrough in planning, contributing to the efficient and transparent management of resources, promoting socio-economic development, the National Assembly issued the Law on Planning on November 24, 2017. Under this Law, the Ministry of Transport submitted the Government the Draft of Law on On-road Transport, Law on Inland Waterway Transport, Viet Nam Maritime Code and Amended Law on railway in order to ensure the consistency and consolidation between regulations in transportation planning and those of the Law on Planning 2017. This volume will discuss some issues of this Draft Law.
Decree No. 37/2006/ND-CP providing in details the Commercial Law on trade promotion, along with Commercial Law 2005 and some specialized laws such as Competition Law, Telecommunication Law, Post Law, Pharmacy Law, etc., have created the legal corridor for trade promotion activities (including sales promotion, commercial advertisement, trade fair and exhibition). However, after 10 yeras, this Decree has showed several problems and it is no longer relevant to the practice as well as the diversity of current trade promotion, which has largely impacted enterprises' business and consumers' interests. Therefore, in our Draft Column this issue, NHQuang&Associates will provide some analyses and comments on the new points of the Draft Decree amending and supplementing this Decree for your reference.
