E-commerce is an inevitable trend in the 4.0 revolution of countries around the world and Viet Nam cannot stand outside this development. However, while Viet Nam’s e-commerce is growing fast, the legal framework has not been able to keep up. The applicable legal documents on e-commerce were issued 05-15 years ago, so they no longer seem suitable to reality, especially regulations related to cross-border e-commerce. Originating from practical requirements and with the purpose of creating a separate legal frameworl to promote and manage cross-border e-commerce activities, In October 2019, the Ministry of Finance prepared a Draft Decree regulating the management of cross-border e-commerce activities in the customs field (Draft). This Draft is expected to make significant contributions to the development of this commercial activity.

From the effective date of the Competition Law 2018 (July 01, 2019) to the present, there are still no documents guiding the implementation of Competition Law’s regulations in general and the handling of violations of the law in the field of competition in particular. In order to solve this problem, at the same time, create a fair competitive environment and ensure effective implementation of Competition Law, the Decree No. 75/2019/ND-CP stipulating penalties for administrative violations in the field of competition (Decree 75) was issued on September 26, 2019.

The crimes related to insurance business, social insurance, health insurance, unemployment insurance have been added to the Criminal Code 2015, amended and supplemented in 2017. However, since then, a number of shortcomings has been found in the prosecution and adjudication of these crimes. No case has been prosecuted for such crimes, for reason that the relevant provisions are still unclear and confused, which requires guidelines for consistent application of laws. Address this problem, the Judge Council of the SPC is completing a Draft Resolution to guide the application of Article 213, 214, 215, and 216 of Criminal Code 2015. In this volume, NHQuang&Associates will provide some comments for a broad view over this Draft.
