Reducing Cconcerns about the “criminalization” of economic relations

The mechanism of “temporarily suspending criminal liability” for violations causing economic damage is one of the notable contents in the Draft Amended Criminal Code. This proposal not only reflects a new legislative mindset – shifting from prioritizing punishment to prioritizing remediation – but also aims to alleviate the “fear of wrongdoing” mentality that is hindering the development of the private sector.

Allowing businesses time to compensate for damages and restore the production environment can have a positive impact on investor confidence. However, for this policy to be implemented fairly, clear criteria and consistency across the entire legal system are needed.
