Training conference on the implementation of the Law on Bankruptcy and Recovery 2025

On the morning of June 30, 2026, the Supreme People’s Court, in collaboration with the International Finance Corporation (IFC), organized a training conference on the implementation of the Law on Bankruptcy and Recovery 2025 and its implementing guidelines for courts in the northern region. The conference aimed to update participants on the new provisions of the Law and its implementing guidelines, drafted by the Supreme People’s Court, to unify understanding and application of legal provisions in practice, especially new issues related to bankruptcy and recovery activities, in order to promote economic development and market health, and to strengthen coordination among relevant agencies and organizations to ensure the effective implementation of the Law.

At the conference, Mr. Nguyen Hung Quang, Managing Partner of NHQuang & Associates, presented the new points of the Law on Bankruptcy and Recovery 2025 related to the activities of asset management officer, asset management and liquidation enterprise, and lawyers participating in business insolvency and recovery. As one of the experts involved in the research and development of the Law on Bankruptcy and Recovery 2025, Mr. Quang analyzed 10 key points that insolvency administrators and lawyers need to be aware of under the new regulations, such as:

  1. Scope of practice, rights and responsibilities, and remuneration;
  2. Appointment and change;
  3. Mediation activities in insolvency and recovery;
  4. Electronically resolving cases;
  5. Role in insolvency procedures;
  6. Role in bankruptcy procedures;
  7. Responsibilities for coordination and support from agencies, organizations, and individuals when fulfilling requests;
  8. The presentation covered the following topics: Mechanisms for supporting the collection of documents and evidence, and asset management;
  9. The role in requesting assistance from competent foreign authorities in resolving corporate bankruptcy;
  10. The role in resolving foreign bankruptcy.

Mr. Quang’s presentation not only introduced legal regulations but also shared practical experiences in the procedures for business recovery, integrated asset sales, and business transfers, clarifying the role of the receiver in the process of business recovery, asset management and liquidation, protecting the rights of stakeholders, and handling cases with foreign elements.
