Abstract of the Chapter on “The Conclusion of E-Contracts in the Boom of E-Commerce in Vietnam”:
This chapter discusses two issues relating to e-contract conclusion – e-contract conclusion via emails and e-messages, and e-contract conclusion via websites and applications (especially livestream) – to demonstrate areas of confusion when applying the traditional approach of contract conclusion to e-contract conclusion. The discussion will analyse relevant regulations of Vietnamese laws in comparison with MLEC, the Convention, and common law (where appropriate) to understand the approach of Vietnamese laws relating to e-contract conclusion, thereby highlighting differences from the traditional legal approach to contract conclusion.
