Implementing the Operational Plan in 2019 of the Steering Committee for interdisciplinary legal assistance programs for enterprises in 2015-2020 period (Program 585), on August 16, 2019 in Da Nang City, the Management Board of Program 585 cooperated with Ministry of Justice (Civil-Economic Legislation Department) to organize 02 Conferences on Enterprise Dialogue with topics: Evaluation on the problems and shortcomings of the law on ownership and other rights to property; Solutions to improve the contract dispute settlement index and enterprise bankruptcy index, contributing to resove difficulties of enterprises in law enforcement. Dr. Nguyen Thanh Tu – Director of the Civil-Economic Legislation Department, Deputy Head of the Management Board of Program 585 chaired these two conferences.
At the first Dialogue Conference, enterprises in Da Nang City talked about the problems and shortcomings of the law on ownership and other rights to property for specific legal provisions and specific cases in Da Nang City and Thua Thien Hue Province, especially cases of public property and land, etc. in the city in recent years (Ms. Phan Thu Duong – Deputy Director of Justice Department of Thua Thien Hue Province also attended this Conference).
The second conference with the topic of solutions to improve the contract dispute settlement index and enterprise bankruptcy index, contributing to resove difficulties of enterprises in law enforcement was attracted the participation of experts, lawyers, representatives of agencies and organizations in the city to assess the advantages of Vietnam’s business environment out of 190 economies as assessed by the World Bank (WB).
At the Dialogue Conference, Mr. Nguyen Hung Quang – President of Vietnam International Commercial Mediation Center (VICMC) said that in order to improve the index of contract enforcement and bankruptcy settlement in Vietnam Nam, it is necessary to study, propose amendments and supplements to the Bankruptcy Law 2014 to improve the quality of bankruptcy regulations; amending and supplementing the Property Auction Law 2016 to overcome the shortcomings of asset valuation and property auctions during judgment execution; amending and supplementing the Law on Enforcement of Civil Judgments 2014 to overcome unreasonable, unclear, non-specific, overlapping, contradictory and different in the relevant contents between the Law on Enforcement of Civil Judgments and Bankruptcy Law.
