Seminar on ‘Asia-Pacific Trusts Law: Theory and Practice in Context’
On 9 and 10 December 2019, Mr. Nguyen Hung Quang – Managing Partner attended the seminar on ‘Asia-Pacific Trusts Law: Theory and Practice in Context’ organized by University of Melbourne, Australia and presented a paper on “How trust survives in Vietnam”. This is a co-author paper between him and Senior Lawyer Nguyen Thuy Duong with the support of the research team of NHQuang & Associates. This paper has an overview on the existence of the trust in the Vietnamese legal system.
The study also found some factors of the “trust” in the emerging legal issues in business activities in Vietnam, such as “time-share” investment in condotel or officetel, real estate investment trust, sham investment, debt collection service, insolventcy practitioner’s activity, and so on. The study found that ancient Vietnamese law had existence of trust link relationship.
The study also provides comments if Vietnam imported trust regulation to its legal system in addition to existing provisions in the Securities Law, the Bankruptcy Law and others…
