Workshop on announcement of the Report on Flow of Business Laws 2020

On January 12, 2021, Mr. Nguyen Hung Quang – Managing Partner of NHQuang&Associates was invited to present at the Workshop on announcement of the Report on Flow of Business Laws 2020 of the Vietnam Chamber of Commerce and Industry (VCCI). The opinion of Lawyer Quang focused on the requirement to ensure the stability of the law.

According to Lawyer Quang, if Viet Nam wants to create a “legal culture” for enterprises and people as well as ensure peace of mind in long-term investment, the system of legal regulations should gradually focus on stability, and limit frequent changes. Therefore:

a. Law-making should be associated with building large doctrines / policies of each norm;

b. Law-making methods or technologies need to change. The large doctrines/policies should be developed large doctrine/policy before norm development. The drafting agencies and individuals must have the task of regulations orientation with a long-term vision, instead of planning to revise once every 10 years, as current psychology and practice;

c. It is necessary to restrict changes to legal documents/regulations because of management and management duties.

At the Workshop, Lawyer Quang also gave some examples of frequent changes in legal regulations that cause damages for enterprises and loss of trust in the legal system from them.
