Don’t let newly enacted laws create new bottlenecks

Through an interview with Mot The Gioi newspaper, Mr. Nguyen Tien Lap – Senior Executive Partner of NHQuang&Associates Law Office – highlights a notable concern in the process of drafting and issuing new regulations: policies that are intended to facilitate governance and economic activity may inadvertently create new bottlenecks. Citing the example of Decree 46/2026/ND-CP on food safety, which reportedly led to congestion of imported agricultural goods at ports and border gates shortly after taking effect, Mr. Lap argues that such problems often stem from the overuse of expedited legislative procedures, insufficient policy impact assessments, and the lack of a transition period for authorities and businesses to prepare for compliance. He emphasizes that improving the quality of lawmaking – by adhering to proper legislative procedures, conducting thorough impact evaluations, and ensuring adequate preparation time – is essential to prevent newly issued regulations from becoming unintended barriers to business and economic activity.
