Workshop on “Commenting on the Draft Decree detailing the implementation of a number of articles of the Law on Land and the Draft Decree regulating land prices”

On the morning of April 23, the Vietnam Chamber of Commerce and Industry (VCCI) coordinated with the Ministry of Natural Resources and Environment to organize a workshop on “Commenting on the Draft Decree detailing the implementation of a number of articles of the Law on Land and the Draft Decree regulating land prices”. These two important drafts are being drafted by the Ministry of Natural Resources and Environment. The workshop was held in Ha Noi with the participation of representatives of enterprises, business associations, and experts exchanging opinions with the Ministry of Natural Resources and Environment, aiming to complete the draft law in a reasonable and feasible manner, creating favorable conditions in the process of implementing investment projects.

At the Workshop, Mr. Nguyen Hung Quang, Managing Partner of NHQuang&Associates, made a contribution to the two Draft Decrees guiding the Law on Land. The contributions focused on a number of issues, including (i) the need to clarify the scope and regulations on “village areas” to be able to apply policies related to land recovery and apply land prices of the vicinities; (ii) the method of determining land prices for underground works according to the provisions of Article 216 of the Law on Land, (iii) the responsibility of land users when “force majeure” occurs to ensure the strictness of the law; (iv) the need to add a number of factors affecting land prices related to the development of urban railways in some large cities; and (v) more clearly defining “value areas” to be consistent with the concept of “village areas” (or TOD areas) so that the State has conditions to develop urban railways in large cities.
