International Conference on Perfecting Institutions and Preventing Investment Disputes
On April 5, 2025, in Ha Long City, Quang Ninh Province, the International Conference “Perfecting Institutions to Realize the Principle of ‘Harmonized Benefits, Shared Risks” in the field of Direct Investment” was held by Vietnam Law Newspaper in coordination with Law and Development Magazine.
Attending the conference, Mr. Nguyen Hung Quang – Managing Partner of NHQuang&Associates, President of Vietnam International Commercial Mediation Center (VICMC), presented a paper titled “Commercial Mediation in Investment Activities – Current Situation and Recommendations to Ensure the Implementation of the Principle ‘Harmonized Benefits, Shared Risks’”.
In his presentation, Mr. Quang emphasized:
- Commercial mediation is important in resolving disputes between the State and investors, especially when problems related to administrative procedures and legal policies can lead to disputes.
- Current situation in Viet Nam: There is currently no clear and unified mechanism to prevent and resolve investment problems early, leading to investors having to resort to complicated complaint channels or seek diplomatic intervention.
- International experience: It is emphasized that disputes should be resolved early to minimize risks and enhance investor confidence.
- Recommendation: It is necessary to build a mechanism for early and effective mediation and dispute resolution, ensuring the harmony of interests between the State and investors, sharing risks in the spirit of dialogue.
Mr. Quang’s presentation made an important contribution to promoting a transparent and sustainable investment environment in Viet Nam, while proposing practical solutions to improve institutions and enhance investment management efficiency.
