Seminar “Revising the Law on Capital: Synchronizing institutions and planning to expand development space”

In the context of Ha Noi facing the demands for rapid and sustainable development, the seminar “Revising the Law on Capital: Synchronizing institutions and planning to expand development space” – organized by the Ha Noi Press, Radio and Television Authority – discussed perfecting the legal framework for the Capital City to facilitate the preparation, approval, and implementation of planning.

The Law on Capital 2024 has provided Ha Noi with a new legal framework with many specific mechanisms, granting Ha Noi stronger powers in management, development, and resource mobilization. Currently, the Law on Capital 2024 is being revised, with further research and proposals for additional mechanisms and policies to be submitted to the National Assembly for consideration, aiming to meet the requirements of rapid and sustainable development of the Capital City in the new phase. In this context, the planning and construction sector is considered a key element, decisively impacting the urban landscape, infrastructure, quality of life for residents, and the long-term development direction of Ha Noi.

At the seminar, Mr. Nguyen Hung Quang – Managing Partner of NHQuang&Associates Law Office, one of the experts involved in drafting the Law on Capital 2024 and the Law on Capital (amended) – presented noteworthy analyses on the relationship between institutions and planning. According to Mr. Quang, one of the major limitations currently is the lack of cohesion between legal regulations and the practical implementation of planning, leading to many obstacles in the process of implementation and ensuring the enforcement of plans. Therefore, the amendment of the Law should aim to design mechanisms that facilitate the preparation and approval of plans, at the same time limiting arbitrary licensing or plan adjustments. Mr. Quang also shared some models from other countries, such as Singapore, London, and Amsterdam, regarding the management and use of underground, low-level, and high-level spaces.

From the discussions at the seminar, it can be seen that the draft Law on Capital (amended) has opened up many new mechanisms in the field of planning and construction, expected to create a breakthrough in Ha Noi’s urban development in the coming period. However, for the law’s provisions to truly be implemented, synchronized coordination in organization and implementation is needed, along with continued improvement of mechanisms and policies suitable to the development requirements of the Capital City.
