Decree 05/2015/ND-CP providing guidelines for the Labor Code has helped enterprises/organizations overcome a great number of difficulties and obstacles in the application of the Labor Code 2012. However, after three years of implementation, the Decree has revealed some shortcomings to be corrected. Aiming to minimize difficulties for both enterprises and organizations in their employment, and also to enhance agreement capacity of both employees and employees in employment contract conclusion, the Government issued Decree 148/2018/ND-CP, which amends and supplements some articles of Decree 05. Arguing the issues involving social insurance payment for foreigners working in Viet Nam, from 2017, in the annual Vietnam Business Forum, a number of foreign-invested enterprises shared that compulsory payment of social insurance for this employee group would raise employers’ costs, including enterprises in general and recruiters in particular, and reduce Viet Nam’s attractiveness as an investment destination.
