On June 18, 2021, the Ministry of Finance issued Circular No. 45/2021/TT-BTC guiding the application of the Advance Pricing Agreement (APA) in tax administration for enterprises with related-party transactions (Circular 45). This Circular takes effect from August 3, 2021 and replaces Circular No. 201/2013/TT-BTC (Circular 201) guiding APA application issued previously.

Key changes in the Advance Pricing Agreement are presented by Nguyen Nhu Khanh Quynh.

Legal Newsletter No. 06/2021

In order to concretize some provisions of the Law on Environmental Protection 2020 (LEP 2020) approved by the National Assembly on November 17, 2020, the Government is drafting a Draft Decree providing details for some articles of this law (Draft Decree). So far, the collection of comments from concerned experts and agencies to complete the contents of these regulations has finised.

New regulations in the Draft Decree providing details for some articles of the Law on Environmental Protection are presented by Nguyen Ngoc Ha.

During nearly 5 years of implementation, Decree No. 50/2016/ND-CP on sanctioning administrative violations in the field of planning and investment (Decree 05) has set forth specific and comprehensive regulations, creating a legal basis for the management in this field. However, this Decree is no longer appropriate when many new relevant legal documents have taken their effect. To ensure consistency between regulations on sanctions for handling administrative violations and other legal documents in the field of planning and investment and simultaneously enhance the efficiency of state management in this field, the Draft Decree to replace Decree 50 (Draft Decree) is currently under consultation and will be promulgated soon.

The Intellectual Property Law (IP Law) was first adopted in 2005. After more than 15 years of its implementation and 02 amendments in 2009 and 2019, the IP Law has played an important role in maintaining a legal framework for the establishment, exploitation and protection of IP rights for intellectual assets of organizations and individuals in Viet Nam. At present, the IP Law is being amended and supplemented (the Draft IP Law) to overcome several problems arising in practice, ensuring conformity to the current science and technology development and meeting the commitments under the international treaties Viet Nam has engaged in.

Legal Newsletter No. 03/2021

On March 9, 2021, the Prime Minister issued Decision 316/QDTTg on approving the pilot implementation of using telecommunications accounts to pay for small-value goods and services (Decision 316), which takes effect from the date of signing. This Decision has paved the way for the deployment of Mobile-Money service, a payment method that had not been governed by law and used in Viet Nam previously.
