Legal Newsletter No. 06/2020

Decree No. 45/2013/ND-CP guiding regulations of the Labor Code on working time, rest time and occupational safety and labor hygiene (Decree 45) has revealed some problems and is no longer suitable to the current socio-economic conditions. With the aim to overcome the shortcomings of Decree 45 and facilitating the implementation of the Labor Code 2019’s new regulations in early 2021, the Ministry of Labor, War Invalids and Social Affairs (MOLISA) has been drafting a Decree on working time, rest time (Draft/Draft Decree) which is expected to generate significant impact on the rights and interests of employees as well as employers.

Legal Newsletter No. 05/2020

On April 8, 2020, the Government issued Decree 41/2020/ND-CP on extending the deadline for paying taxes and land rents (Decree 41). In order to support taxpayers in the context of COVID-19 outbreak in Vietnam, Decree 41 takes effect from the time of its issuance with the support value of VND 180,000 billion. Accordingly, the taxpayers will be extended the time limit for paying value-added tax (VAT), corporate income tax (CIT), personal income tax (PIT) and land rent.

On February 1, 2020, the Prime Minister issued Decision No. 173/QD-TTg announcing the acute respiratory infection epidemic caused by the new strain of Coronavirus. After more than one month, the World Health Organization (WHO) has announced the outbreak of COVID-19 due to the new strain of Coronavirus (SARS-CoV-2) as a global pandemic (COVID-19 Outbreak). Most recently, the Prime Minister has just signed Decision No. 447/QD-TTg dated April 1, 2020 on announcing the nationwide outbreak of COVID-19. The COVID-19 pandemic has seriously affected the world economy in general and Vietnam’s economy in particular. This effect threatens to change or terminate the performance of contracts between entities engaging in civil and economic transactions.

Legal Newsletter No. 03/2020

Decree No. 101/2012/ND-CP on non-cash payments (along with some amended and supplemented contents in Decree No. 80/2016/ND-CP and Decree 16/2019/ND-CP) – hereinafter referred to as “Decree 101“, brought many positive changes in the payment activities of the economy, promoted non-cash payment activities. However, after many years of implementation, Decree 101 had no longer been suitable for economic development conditions, exposed many limitations and obstacles in implementation. In order to overcome the above problems, the State Bank of Vietnam is in the process of developing a draft Decree replacing Decree 101 (Draft Decree).
